Terms & Conditions

The terms governing use of the Nib font editor, including accounts, content ownership, and acceptable use.

Welcome to Nib (“Service”), operated by the individual owner of Nib (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms & Conditions (“Terms”). If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using Nib, you represent that you meet this requirement.

2. Accounts

To access certain features, you may need to create an account.

You agree to:

  • Provide accurate registration information
  • Maintain the security of your account credentials
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe intellectual property rights
  • Upload malicious code or harmful content
  • Attempt unauthorized access to systems or data
  • Reverse engineer, scrape, or overload the Service

We may investigate violations and take appropriate action, including account suspension.

4. User Content

Nib allows you to create, upload, and store content such as designs, font files, glyph data, or other creative assets (“User Content”).

You retain ownership of your User Content.

By using the Service, you grant us a worldwide, non-exclusive license to:

  • Host
  • Store
  • Process
  • Display

your User Content solely for the purpose of operating, maintaining, and improving the Service.

You represent that you have all rights necessary to submit this content.

5. Intellectual Property

All software, infrastructure, branding, and technology underlying Nib are owned by us or our licensors and are protected by intellectual property laws.

These Terms do not grant you ownership of the Service itself.

6. Billing & Subscriptions (If Applicable)

  • Fees are billed in advance on a recurring basis
  • Payments are non-refundable unless required by law
  • You may cancel at any time; access continues through the paid period
  • We may modify pricing with reasonable notice

Failure to pay may result in suspension or termination.

7. Service Availability

We strive to maintain reliable uptime but do not guarantee uninterrupted availability.

We may:

  • Modify or discontinue features
  • Perform maintenance
  • Restrict access

with or without notice.

8. Data & Privacy

Use of the Service is also governed by our Privacy Policy.

We implement reasonable safeguards but cannot guarantee absolute security.

9. Third-Party Services

Nib may integrate with third-party providers (e.g., storage, authentication, or APIs).

We are not responsible for:

  • Third-party outages
  • Data handling practices
  • Security controls

Your use of third-party services is at your own risk.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

We disclaim all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee the Service will be error-free or uninterrupted.

11. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the greater of:
    • Amount you paid us in the past 12 months, or
    • $100 USD

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms

13. Termination

We may suspend or terminate your access at any time if you violate these Terms.

Upon termination:

  • Your right to use the Service ends immediately
  • We may delete your data after a reasonable retention period

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any disputes shall be resolved in the state or federal courts located in New York County, New York.

15. Changes to Terms

We may update these Terms from time to time.

If we make material changes, we will:

  • Update the effective date
  • Provide notice where reasonable

Continued use of the Service constitutes acceptance.
